DNC & Calling Compliance

Do Not Call registries

  • Telemarketing calls to numbers on the National Do Not Call Registry are prohibited without an established business relationship or prior express written consent.
  • Many states operate their own DNC lists with additional restrictions.
  • You must maintain your own internal Do Not Call list and honour opt-out requests immediately, and for at least five years.
  • Where our records carry a DNC indicator, treat it as a signal — not as a substitute for scrubbing against the official registry before a campaign.

TCPA and autodialers

  • Prior express written consent is required before using an autodialer or prerecorded/artificial voice to call a wireless number for marketing.
  • SMS marketing requires the same level of consent, with clear opt-out instructions in the message.
  • Statutory damages under the TCPA run from $500 to $1,500 per violating call or text.

Calling hours and identification

  • Telemarketing calls are restricted to 8:00 a.m. – 9:00 p.m. in the recipient's local time; some states are stricter.
  • You must identify yourself, your company and the purpose of the call promptly.
  • Caller ID must not be spoofed or misleading.

Email (CAN-SPAM)

  • Use accurate headers and non-deceptive subject lines.
  • Disclose that the message is an advertisement where applicable.
  • Include a valid physical postal address and a working unsubscribe mechanism, honoured within ten business days.

Recording calls

Several states require all-party consent to record a call. Confirm the rules for both your location and the recipient's before recording.

Prohibited uses

Contact records may not be used for eligibility decisions governed by the Fair Credit Reporting Act, for stalking or harassment, or for any unlawful purpose. Violations result in immediate termination without refund.
